1. Introduction
Welcome to Pay2Gym. Pay2Gym (the “Platform”) is a fitness booking and payments platform developed and managed by ShaSam Infotech. These Terms & Conditions (the “Terms”) govern your access to and use of the Pay2Gym website, mobile applications, wallet services and related offerings (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Services.
2. Definitions
In these Terms, unless the context otherwise requires:
- “Pay2Gym” or “Platform” means the services, website and mobile application operated by ShaSam Infotech.
- “User” means any individual or entity who registers on or uses the Platform.
- “Gym Partner” means any fitness studio, gym, trainer, or vendor listed on the Platform that offers services to Users.
- “Wallet” means the prepaid account balance maintained by the User on the Platform.
- “Booking” means a session, class or facility reservation made through the Platform and accepted by a Gym Partner.
- “Content” means all information, text, images, graphics, logos, audio, video and other materials available on the Platform.
3. Eligibility
You must be at least 18 years old to register as a User on Pay2Gym. Minors may use the Platform only under the supervision and with the consent of a parent or legal guardian. By registering, you confirm that you are legally capable of entering into binding contracts and that the information you provide is accurate and complete.
4. Account Registration & Security
To access certain features of the Platform, you must create an account. You agree to: (a) provide true, accurate and up-to-date information; (b) maintain the confidentiality of your password and account; and (c) notify Pay2Gym immediately of any unauthorized use of your account. You are solely responsible for all activity that occurs under your account.
5. Services
Pay2Gym provides an online marketplace that allows Users to discover Gym Partners, view availability, book sessions/classes and pay via the Wallet or supported payment methods. Pay2Gym is a technology facilitator and does not provide fitness services directly; Gym Partners provide the actual services.
6. Wallet, Payments & Fees
- Wallet Minimum & Usage: Users may be required to maintain a minimum Wallet balance (for example, ₹300) to confirm certain Bookings. Wallet funds are non-withdrawable and non-interest-bearing unless otherwise stated.
- Top-ups & Payment Methods: Wallet top-ups and payments may be made using the payment methods supported on the Platform. By adding funds, you authorize the relevant payment provider to process the transaction.
- Platform Fees: Pay2Gym may charge a platform fee, commission or service charge on bookings. Such fees will be disclosed at the time of Booking or in the Platform pricing terms.
- Payment Capture & Settlement: Payments to Gym Partners are subject to the Platform’s payment flow and settlement schedules. Pay2Gym will process payouts to Gym Partners after deducting applicable commissions and fees.
7. Bookings, Check-in & Cancellations
- Booking Confirmation: A Booking is confirmed only when the Gym Partner accepts the booking or when the Platform indicates confirmation. Availability displayed on the Platform is subject to change.
- Check-in: Some Bookings may require on-premise check-in by the User, which the Gym Partner must acknowledge. Payment capture rules depend on the check-in and confirmation flow.
- Cancellation by User: Users may cancel Bookings in accordance with the specific cancellation rules displayed at the time of Booking. Cancellations made prior to Gym Partner confirmation may be eligible for wallet refunds per the Platform policy.
- Cancellation by Gym Partner: If a Gym Partner cancels a confirmed Booking, Pay2Gym will attempt to rebook or refund the affected User as per the refund policy.
8. Refund & Cancellation Policy (Summary)
- Wallet Top-ups: Wallet top-ups are generally non-refundable except in cases of duplicate charges or verifiable technical errors. Eligible refunds will be credited to the original payment method or Wallet as specified and processed within 7–10 working days.
- User Cancellations: If a User cancels before gym confirmation, amounts may be re-credited to the Wallet. No refunds are provided after check-in confirmation unless otherwise determined during dispute resolution.
- Gym Partner Cancellations & Service Failure: If a Gym Partner is unable to provide the service, affected Bookings will be refunded to the Wallet after verification, typically within 3–5 working days.
- Technical Issues: Report failed transactions or duplicate charges to support@pay2gym.com within 48 hours for timely investigation and resolution.
9. User Obligations & Conduct
Users must: (a) behave respectfully at Gym Partner premises; (b) comply with health and safety instructions; (c) not misuse the Platform; and (d) not attempt to manipulate reviews, ratings or promotions. Violations may lead to suspension or termination.
10. Gym Partner Obligations
Gym Partners must deliver services as described, maintain lawful operations and comply with all health and safety regulations. Gym Partners are solely responsible for on-premise incidents, staff conduct, and service quality.
11. Intellectual Property
All intellectual property rights in the Platform and its Content are owned by ShaSam Infotech or its licensors. Users may not copy, reproduce or use such Content without prior written permission.
12. Privacy & Data Protection
Your use of the Platform is also governed by the Pay2Gym Privacy Policy, which explains how we collect, use, disclose and protect personal information. By using the Platform you consent to the collection and use of information as described in the "Privacy Policy".
13. Limitation of Liability
To the maximum extent permitted by law, Pay2Gym and ShaSam Infotech will not be liable for indirect, incidental, special or consequential damages arising out of or in connection with the Services. Our total aggregate liability for direct damages will not exceed the amount paid by the User for the relevant Booking in the 12 months preceding the claim.
14. Indemnity
You agree to indemnify, defend and hold harmless Pay2Gym, ShaSam Infotech and their affiliates from any claims, losses, liabilities and expenses arising out of your breach of these Terms, your use of the Platform or your violation of applicable laws.
15. Termination & Suspension
Pay2Gym reserves the right to suspend or terminate accounts for violations, fraudulent activity or misuse. On termination, access to the Platform will cease and certain data may be retained as required by law or for legitimate business purposes.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Hyderabad,India. Users agree to attempt to resolve issues through Pay2Gym support prior to initiating formal legal proceedings.
17. Changes to Terms
Pay2Gym may modify or update these Terms at any time. Material changes will be communicated via email and posted on the Platform. Continued use of the Services after such changes constitutes acceptance of the updated Terms.
